498a and maintenance issues

    Hello All,

    Please let me know that if a wife loses a 498a case can she apply for maintenance.

    Are there any clauses where a wife cannot claim maintenance if 498a is proved false and the wife is not given any maintenance due to cruelty towards husband.

    There is a SC judgement which says that woman who is not able to prove cruelty cannot get maintenance. Search for it in the knowledge section.

    Hello

    She is not educated, only 10 th standard.
    The only option can be the false 498a.
    Is this a ground for not providing Maintenance?
    What are the possibilities for her to lose the case.

    Till you wife will not remarry & have sufficient means of maintenance, she has right of maintenance.,
    You file divorce petition , get free from her, she will remarry & you will be totally freed from her.

    sir even on the basis on a false 498a, am i not having any advantage to fight for no maintenance.
    are the laws so biased towards women.

    So what is the point then even if the wife cannot prove cruelty she is still eligible to get a maintenance?

    Many Women (I wudn't say all ) is takng advantage of it and we land up loosing everything.

    So the SC judgement doesn't hold good.... I am asking this because am in a similar situation with a slight difference my wife is well educated ,unemployed currently but very much elligible for a job(i think she is going to try it once she gets a heavy amount from me)
